Release & Assumption of Risk

Every participant must complete this waiver before flying. Please read carefully — it protects both you and the association.

About this waiver. This is the standard release form used by paragliding operations across Canada. By signing, you're acknowledging that free flight carries real risk and releasing Adaptive Airtime and our partners from liability so we can keep offering these flights. About Adaptive Airtime

Adaptive Airtime Paragliding Association (AAPA) is a Canadian non-profit dedicated to making free flight accessible to everyone. We fly people with spinal cord and brain injuries, mobility limitations, and a wide range of disabilities and special needs. Our instructors are certified by HPAC (the Hang Gliding and Paragliding Association of Canada), and our equipment includes custom trike-chairs that make tandem flight possible for people who can't foot-launch. Our team runs largely on volunteer time.

This waiver protects the volunteers, instructors, landowners, and organizations who make your flight possible.

Before your flight

Definitions

Two terms appear throughout this waiver:

"Hang Gliding" covers all activities related to preparing for or participating in unpowered flight — hang glider, paraglider, tandem flight, training, instruction, competitions, fly-ins, clinics, towing programs, and related advice, equipment or events. This waiver uses the term "Hang Gliding" throughout for consistency with the national standard; it applies equally to paragliding (which is what Adaptive Airtime does).

"Releasee" means the people, organizations, and property owners you're releasing from liability. This includes:

  • Adaptive Airtime Paragliding Association ("AAPA") and its officers, directors, representatives, employees, volunteers, and members
  • The Hang Gliding and Paragliding Association of Canada / Association Canadienne De Vol Libre ("HPAC" / "ACVL") — Canada's national governing body — and its officers, directors, representatives, employees, and volunteers
  • HPAC/ACVL certified instructors in good standing
  • Landowners — owners, lessors, and occupiers of land where Hang Gliding takes place, whether or not they have granted permission for that use
  • Affiliated clubs and schools — clubs comprised primarily of HPAC members, or Hang Gliding schools whose instructors are certified by HPAC, The Aeroclub of Canada, the Fédération Aéronautique Internationale, or its Commision Internationale de Vol Libre — and their officers, directors, representatives, employees, volunteers, and members
  • Event organizers — Meet Directors of HPAC/ACVL and/or AAPA sanctioned events or competitions, and their designated volunteers
  • Anyone else — any other persons, corporations, partnerships, societies, clubs, or other organizations acting in any capacity in the provision, promotion, organization, production, facilitation, and operation of Hang Gliding

Release, Waiver, Indemnity and Assumption of Risk Agreement

IN CONSIDERATION FOR being permitted to participate in Hang Gliding I release and discharge the Releasee(s) from all liability. I waive as against the Releasee(s) all recourses, claims, and causes of action of any kind whatsoever, in respect of all personal injuries or property losses — specifically including, but not limited to, any claims for loss of income — which I may suffer arising out of or connected with my preparation for, or participation in, Hang Gliding, notwithstanding that such injuries or losses may have been caused solely or partly by the negligence of the Releasee.

Part 1 · You understand the risks

Free flight is a beautiful sport, and also a genuinely dangerous one. These acknowledgments make clear that you understand what you're stepping into.

Hang Gliding is very dangerous, exposing participants to many risks and hazards, some of which are inherent in the very nature of the sport itself, others which result from human error and negligence on the part of persons involved in preparing, organizing and staging of Hang Gliding activities;

As a result of those risks and hazards, I as a participant may suffer serious personal injury, disability, and even death, as well as property damage or loss;

Some of the risks and hazards of Hang Gliding are foreseeable, others are not; I understand and acknowledge that Hang Gliding has inherent dangers that no amount of care, caution, or expertise can predict or eliminate;

I freely and voluntarily assume all risks and hazards of my participation in Hang Gliding. My preparation for, and my participation in, Hang Gliding is entirely at my own risk. I am solely responsible for my own safety.

Part 2 · You're medically fit to fly (or have disclosed anything relevant)

Free flight puts real stress on the body — G-forces during launch, cold at altitude, exertion during landing. We need to know about anything that could put you or your instructor at risk. You can note medical details below in the "Medical notes" field, or tell your instructor directly on the day.

I do NOT have any pre-existing medical conditions which may impair my ability, or that of my fellow participants, to participate safely in Hang Gliding, including but not limited to any previous heart conditions, asthma, panic disorders, previously separated shoulders, joint issues and/or torn ligaments, and/or severe allergies. IF I am under the care of a Doctor, utilize an epi-pen, inhaler, and/or any medications in relation to the foregoing or any other condition, I have disclosed the same to my course instructor.

Declaration of Fitness. I hereby declare that I am physically fit. I do not, and have not, suffered from any of the following conditions, which I understand may lead to a dangerous situation for other persons or myself during Hang Gliding activities: epilepsy, fits, severe head injury, recurrent blackouts or giddiness, disease of the brain or nervous system, high blood pressure, lung or heart disease, recurrent weakness or dislocation of any limb, inadequate mobility, diabetes, mental illness, drug or alcohol addiction, back injury, arthritis and severe joint sprains, chronic bronchitis, asthma, rheumatic fever, thyroid adrenal or other glandular disorder, recent blood donation, or any condition that requires the regular use of drugs.

Even if I have a health condition as stated above of which I may be aware and not disclosing, or if I have a health condition listed above that I am unaware of having, by signing this form I still choose to participate in the gliding activity and agree to waive all responsibilities to all above-mentioned parties concerning any consequences that would result from my actions.

I hereby declare that I have no physical or mental condition that should preclude me from participating in my chosen activity, that I am not participating against medical advice or treatment, and that I have not been diagnosed by a registered doctor as having a terminal illness.

I further declare that in the event that I feel ill or unwell, have any physical complaints whatsoever, or if an injury is sustained of any kind during the course of gliding activities, I will notify the instructor immediately.

I have read the above Declarations, understand them, and I agree to be bound by them.

Part 3 · You're releasing Adaptive Airtime and its partners from liability

These are the legal teeth of the waiver. In plain terms: if something goes wrong, you're agreeing not to sue AAPA, our instructors, HPAC, the landowners, or anyone else involved in making your flight possible — even if the injury was caused by their negligence.

I understand and agree that the Releasee is in no way responsible whatsoever for my safety during the course of preparing for, or participation in, any Hang Gliding;

I will not sue, make a claim, or make a demand against any of the Releasee(s) for injury, loss, death, or damage in connection with participating in Hang Gliding. If I violate this agreement by filing such a suit, making such a claim, or making such a demand, I agree to pay all of the Releasees' legal fees, costs, and expenses in connection with my violation of this AGREEMENT.

By signing this document I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless the Releasee(s) as defined herein, for any loss or damage to any property or for personal injury that I may sustain while participating in, or preparing for, Hang Gliding programs or activities — whether or not such loss or injury is caused solely or partly by the negligence of the Releasee(s).

Part 4 · You've made this decision freely, with time to consider it

Sports waivers are only enforceable when signed knowingly and voluntarily. These acknowledgments confirm you weren't pressured, you had time to read, and you understood what you were signing.

I have carefully read this RELEASE, WAIVER, INDEMNITY, AND ASSUMPTION OF RISK agreement. I fully understand it, and I am freely and voluntarily signing my name in full agreement;

I have been provided with a reasonable opportunity and have been encouraged to seek independent legal advice prior to signing this agreement;

This RELEASE, WAIVER, INDEMNITY, AND ASSUMPTION OF RISK is binding on me, my heirs, my executors, administrators, personal representatives, and assigns;

I have had sufficient opportunity to carefully read this entire document. I have read and understood it. I have not signed this document under any duress or coercion by any other person or persons. I have chosen to sign it of my own free will and choice. I have obtained independent legal advice before signing or have chosen to waive obtaining such advice. I agree to be bound by its terms.
